If your business touches Brazil’s telecom market, it’s time to pay close attention. On August 1, 2025, Brazil’s National Telecommunications Agency (ANATEL) published Resolution No. 780, introducing significant amendments to the country’s primary certification regulation (Resolution 715).
For manufacturers, importers, and particularly for e-commerce platforms and data center operators, the message is clear: the rules of engagement have evolved.
Online Marketplaces are Now on the Hook
The most significant change is a direct strike against the sale of non-compliant products online. Under the new rules, e-commerce platforms (marketplaces) are now held jointly responsible with sellers for the products offered on their sites.
What this means for you:
- Shared Responsibility: Marketplaces must actively verify that products sold on their platform are properly homologated by ANATEL.
- Mandatory Homologation Codes: It is now a punishable offense to advertise a product electronically without clearly displaying its valid ANATEL homologation code. Using a fake or incorrect code is also explicitly forbidden.
- A Grace Period to Comply: ANATEL has given marketplaces and sellers a four-month grace period from the date of publication to implement these changes before enforcement begins.
This move fundamentally shifts the burden of compliance, forcing a new level of partnership between product manufacturers and their online retail channels.
Data Centers
In another major development, Resolution 780 officially brings data centers that form part of telecommunications networks under ANATEL’s conformity assessment framework.
Key highlights of this new requirement include:
- Mandatory Approval: Before beginning operations, new data centers must be assessed and homologated against ANATEL’s rules.
- Strict Requirements: Certification will focus on critical aspects like robust cybersecurity, physical security, operational continuity, and energy efficiency.
- Transition for Existing Facilities: Current data centers will have a three-year period to adapt and achieve compliance once the specific operational procedures are published by ANATEL (expected within 240 days).
